Because California has liberal jurisdiction and venue laws, if either the prospective adoptive parents or the birth mother reside in California, a same-sex couple can jointly finalize the adoption together whether or not they are married. While the laws of other states differ on the issue of unmarried gay and lesbian parents jointly adopting, there are many states that have progressive adoption laws similar to California. In the unlikely event that a state passes discriminatory adoption laws for gay and lesbian adoptive parents, we can finalize the adoption outside of that state or we can utilize step and second parent adoption to complete the adoption process.

The United States Constitution requires that adoptions finalized in one state must be legally recognized by all other states, thus adoption still offers the most security in protecting the parent-child relationship of gay and lesbian parents across jurisdictions.
